Can materials from NYU’s online collections be used in the university’s learning management system, or in learning tools integrated with the system?

If you are considering linking to library resources from a Brightspace course page, you can do this freely. Linking is not “reproduction,” so you are not touching on the rights of copyright holders when you direct students to a link where they can lawfully access course materials. If you are considering posting a copy of the material in Brightspace, make an evaluation to consider whether fair use in copyright law covers your intended use. The Libraries’ Fair Use guide page provides a starting point to learn the four-factor framework for fair use evaluations, and Columbia Libraries’ Fair Use Checklist is a useful tool to guide an evaluation. The Libraries’ Open Knowledge team can assist by providing information and explanations about copyright, fair use and its terminology, though the team does not perform fair use evaluations on anyone’s behalf. With regard to loading the materials to Brightspace-integrated third-party learning tools such as Perusall, this can sometimes depend on the terms of the Libraries’ license with the vendor of the material.
